The Committee on Political Subdivisions moved to amend the bill on page 1, section 4, line 5, by striking “or special municipal election.” and inserting in lieu thereof “hold a referendum at the time of the next upcoming primary or general election”;

And,

On page 1, section 4, line 8, by striking the words “The holding of a special municipal election to submit” and inserting in lieu thereof “As part of a regular municipal election a submission shall be made”;

And,

On page 1, section 4, lines 13-14, by striking the words “hold a special municipal election” and inserting in lieu thereof “hold a referendum at the time of the next upcoming municipal election”;

And,

On page 1, section 4, following subsection (b) by adding thereto the following:

“(c) Notwithstanding the provisions of West Virginia Code §8-12-4, in the event that a municipality has provisions in the charter of the municipality providing for recall of ordinances or elected officers, the provisions in said municipal charter shall remain in effect and take precedence over West Virginia Code §8-12-4 and not be rendered moot or stricken thereby.”
